Learn AI mobile application (End-User License Agreement)

1. Acceptance of terms

These Terms of Use ("Terms") are a binding agreement between you and Anton Vodolazkyi, an individual residing in Ukraine ("we", "us", "our"), governing your use of the Learn AI mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to consent to the processing of your personal data) to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.

3. The service

Learn AI is an educational application that provides interactive courses and lessons about artificial intelligence and related topics. The content is provided for general informational and educational purposes only. We may add, change, or remove features, courses, and content at any time.

4. Your account

You may use parts of the App anonymously, but some features require an account. You may create an account using email and password, Sign in with Apple, or Sign in with Google. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use of your account.

5. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, in accordance with the App Store Terms of Service and the Usage Rules set out in the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent such restriction is prohibited by applicable law.

6. Subscriptions & payments

The App offers an optional auto-renewable subscription ("Learn AI Premium") that unlocks premium content and features. Subscriptions are sold and processed by Apple through your Apple ID. Full subscription details — plans, billing period, auto-renewal, free trials, and cancellation — are set out in our Subscription Terms, which are incorporated into these Terms by reference.

Auto-renewal (summary): Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription in your Apple ID Account Settings.

7. Free features

The App provides certain content free of charge, which may include a limited number of free lessons. We may change what is available for free at any time.

8. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms;
  • Interfere with or disrupt the App, its servers, or networks;
  • Attempt to gain unauthorized access to any part of the App or another user's account;
  • Copy, scrape, republish, or redistribute the App's content without our permission;
  • Use the App to infringe the rights of others or to transmit harmful or malicious code.

9. Intellectual property

The App and all of its content, including courses, lessons, interactive scenes, text, graphics, design, software, and trademarks, are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you. "Learn AI" and our logos are our trademarks; you may not use them without our prior written consent.

10. Third-party services

The App relies on third-party services (including Apple, Google, Supabase, RevenueCat, and PostHog). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.

11. Disclaimers

THE APP AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure, or that its educational content is complete, accurate, or suitable for any particular purpose. The content is not professional advice.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory statutory consumer rights.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or applicable law.

14. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

15. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Any dispute will be subject to the competent courts of Ukraine, unless mandatory consumer-protection laws of your country of residence provide otherwise. If you are an EU/EEA consumer, you retain the protection of the mandatory provisions of the law of your country of residence.

16. Apple-specific terms

The following additional terms apply because the App is distributed through the Apple App Store:

  • These Terms are concluded between you and us only, and not with Apple. Apple is not responsible for the App or its content.
  • The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to furnish any maintenance or support services for the App.
  • In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility.
  • We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
  • In the event of a third-party claim that the App or your use of it infringes that third party's intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of such claim.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.
  • You must comply with applicable third-party terms of agreement when using the App.

17. Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after the changes take effect constitutes acceptance of the updated Terms.
